Privacy Statement for the Processing of Personal Data by the Various TKB Entities
(“TKB”)

This privacy statement concerns the processing of personal data by TKB through its
website (www.tkb.nl) and in relation to the services it provides to its clients in the field of
debt collection and receivables management.

Trust Krediet Beheer B.V. (TKB) is the controller for the processing of personal data
within the meaning of the General Data Protection Regulation (GDPR), insofar as we
determine the purposes and means of the processing activities, such as processing
carried out through this website. In the running of our services in accordance with the
instructions of our clients, we qualify as a processor and comply with the obligations
that apply to us in that capacity.

General
TKB handles personal data with great care. TKB carefully complies with the relevant
legislation in this field. We do this by working together with our legal partner to ensure
that our services meet the required standards, both in terms of data security and
compliance with data protection legislation. TKB endorses the principles of the GDPR.

TKB as Processor
When we act in the capacity of a processor of personal data, we proactively offer our
clients a data processing agreement, in which we address, for example, legislation
regarding data breaches. We maintain a data breach protocol and closely monitor any
potential incidents.

Data We Process from Visitors to the Website
TKB respects the privacy of visitors to our website and the services offered on it. We
only collect personal data that are necessary for displaying the website and the services
offered on it.

For statistical purposes, TKB uses Google Analytics. Google Analytics places analytical
cookies to gain insight into the use of our website. The information collected, including
the (anonymized) IP address, is processed by Google.

We collect the above data so that we can optimally tailor the content of the Website to

To measure business use of our website, TKB uses the service Leadinfo from Rotterdam.
This service recognizes business visitors based on IP addresses and links them to
publicly available company data.

This process is based on TKB’s legitimate interest in gaining insight into the use of its
website by business visitors.

When Do We Collect Personal Data?
Among other things, from the moment you visit our website, enter personal data on it, or
contact us regarding services to be provided by us.

Why Do We Collect Personal Data?
We collect and process personal data, among other things, for the performance of our
services and to bring these services to your attention and keep you informed about
them.
More specifically, we process personal data:
1. To comply with the laws and regulations applicable to TKB;
2. To carry out TKB’s debt collection activities on behalf of our clients and, in the
case of outsourcing services, to perform receivables management on behalf of
our clients;
3. In the case of a job application: assess your suitability for a specific position,
record your availability and invite you for an interview;
4. To inform you about our services, professional information and/or other activities
and to make offers to you on behalf of TKB;
5. To enable you to use and access our secure website, portals and other online
environments;
6. In the case of recorded telephone conversations: for training and quality
purposes, to prevent aggression against our employees and for investigative
purposes.

Legal Grounds on Which We Base the Processing of Your Personal Data
We base the processing of your personal data on various legal grounds. A large part of
the personal data we process is necessary to fulfil our agreement with our clients
(Article 6(1)(b) GDPR). In addition, we process your personal data because it is
necessary for the purposes of our legitimate interest in informing you about our
activities and making offers to you (Article 6(1)(f) GDPR).
Finally, in some situations we are legally required to process certain personal data, such
as your citizen service number (BSN) and a copy of your identification document, for
example when you become employed by us.
TKB will only process your personal data for other purposes than those mentioned
above if you have given your consent.

What (Personal) Data Do We Collect?
We collect personal data that we need to provide our services. Some of this personal
data are required to use our services. In addition, we collect supplementary (personal)
data that enables us to tailor our services to your specific qualities and preferences.
You are responsible for the accuracy and relevance of the data you provide to us.
Among other things, we collect the following data and documents containing personal
data.

Clients
Our clients are mainly companies (legal entities), which means that the data processing
does not usually concern personal data. However, TKB processes the contact details
(including name and email address) of people working for clients who contact TKB.
If employees or other people associated with our clients use the digital login portal, TKB
also processes the login details of those persons

Debtors of Our Clients
In many cases these are business details (and therefore not personal data). If, for the
correct execution of debt collection activities and receivables management on behalf of
our client, the data of a contact person of a debtor must be processed, TKB will also
process those data.
This usually concerns the name, gender and contact details (email address and/or
telephone number) and data necessary to carry out the debt collection activities or
receivables management, such as the amount of the outstanding claim.
If the debtor of a client of TKB is an individual person/consumer, the name, address and
place of residence (NAW data) and possibly contact details such as email address
and/or telephone number will be processed, as well as the data necessary to carry out
the debt collection activities or receivables management.
The processing of this debtor data is carried out in accordance with the instructions of
our clients, who also provide these data to us.

Debtors of Our Clients
The (personal) data of the debtors of our clients is received from our clients.

Special Categories of Personal Data
TKB will only process special categories of personal data when this is necessary to
comply with legal obligations, when consent has been given, or when this is permitted
by or pursuant to law.
Special categories of personal data refer to sensitive information, such as data about a
person’s race, religion or health.

How Long Are Collected Personal Data Retained?
We retain data of our clients for a maximum of two years after the termination of the
relationship and/or after the last transaction.
Data of the debtors of our clients and the data of our own debtors are retained for a
maximum of seven years after payment of the last invoice, unless a different retention
period is agreed with our client.

If you have applied for a vacancy at TKB, your personal data will be deleted after you
request this or four weeks after the application procedure has ended, unless you have
given TKB permission to retain the personal data for one year after the application
procedure has ended.

How Are Collected Personal Data Secured?
TKB attaches great importance to your privacy. For this reason, we take various
measures to prevent loss, theft or unlawful use of your personal data.

Where necessary we use encrypted communication and secure connections. In
addition, we take the necessary measures regarding physical and logical access
security.

We do not process the personal data to which we have access in the context of our debt
collection activities and receivables management for any purpose other than those
determined by our client.

If personal data are processed by parties outside the European Economic Area (EEA),
TKB will ensure that appropriate safeguards are implemented in accordance with the
GDPR, for example by using Standard Contractual Clauses approved by the European
Commission or by processing in countries for which an adequacy decision applies.

The personal data to be processed remains the property of our clients and/or the
relevant data subjects. Naturally, we treat personal data with the utmost confidentiality.

Who Receives Your Personal Data?
TKB receives your personal data. TKB will under no circumstances sell your personal
data to third parties.

TKB may share personal data with third parties when this is necessary for the
performance of its services, when required by law, or when consent has been obtained.

This may include, among others:
• bailiffs, lawyers and other legal service providers
• accountants and auditors
• other parties engaged by TKB in the execution of its services

Where required, data processing agreements are concluded with parties that process
personal data on behalf of TKB.

If you consent to the processing of your data by means of certain cookies when you first
visit our website, certain data may be shared with third parties to offer you personalized
advertisements, to generate interest in vacancies at TKB, or for other recruitment
purposes.

Can I Submit a Request to Access, Correct or Delete My Personal Data Collected by
TKB?
You can submit a request to access, delete or correct the personal data collected about
you by TKB via its Website.

You can do so by sending an email to privacy@tkb.nl.

Following such a request, you may ask TKB to correct or delete your personal data.
Debtors must address these requests to our clients.

If you believe that we are not handling your personal data carefully, you can contact us
via the contact details above. You also have the right to lodge a complaint with the
Dutch Data Protection Authority (Autoriteit Persoonsgegevens).

Objection to the Processing of Your Personal Data by TKB
You may object to the processing of your personal data by TKB if your personal data are
used for purposes other than those necessary for the performance of an agreement or
compliance with a legal obligation.

For example, you may object to the use of your personal data for marketing and sales
activities. You can do this by sending an email to privacy@tkb.nl.

You also have the right to data portability, which means that you have the right to receive
the personal data concerning you that you have provided to TKB in a structured format.
You can request this by sending an email to privacy@tkb.nl.

If you object to the processing of personal data necessary for the performance of our
services, we consider it important to mention that without your personal data we
cannot provide our services.
